At the moment it seems like M$ is adding it to their AAA titles in most cases but as seen not to all titles, I can only imagine the reason for this is that its a test to see if any boxes react badly to the new format as its different to the previous wave updates.

I also very much doubt M$ are charging anything extra for this new protection, it serves / served them a purpose as well. Any extra cost would undoubtedly be passed on to the customer which would not go down very well in these cash strapped times.

As the intention of the new format is to cause interruption of the feed of copies and the ability to run them I can’t see M$ dropping this format, all they will do is try new tricks.

Many people think M$ are trying to stop piracy dead but you should not think M$ are that naive, they like all hardware makers fully expect very bright people to try and compromise their console, the time it takes is calculated with the expected life of that model and its fair to say the 360 has done quite well in that stakes, M$ basically are just making it harder for the viable life of the 360 to use if illegally, as the 360 is starting to come to its end I suspect the effort to defeat firmwares will start to wane, to be honest, this might be M$’s last big fight against the copy side bar a smattering of minor updates.
